01Acceptance of Terms & Legal Eligibility

Use of ChartRoom (the "Service") is subject to these terms. Accessing or using the app constitutes full agreement to these terms. If you do not agree — do not use the Service.

By using the Service you represent and confirm that you are at least 18 years old, and that you have full legal capacity to enter into this binding agreement and to independently carry out trading and other financial transactions. The Service operator may block or cancel the account of a user who does not meet this requirement.

02Service Description, Availability & Maintenance

ChartRoom is a digital trading journal that lets you log trades, analyze performance, use a stock screener, and connect to brokers via API for automatic import of trade data. The Service is provided "as is," with no commitment to continuous availability or a 100% service level (SLA).

The Service, in whole or in part, may be temporarily unavailable due to maintenance, upgrades, server updates, communication failures, or other factors outside the Service operator's control. Where possible, the operator will make a reasonable effort to give advance notice of planned maintenance, but this does not create any obligation or liability for such downtime.

03No Financial Advice

The Service does not constitute and is not intended to constitute:

• Investment advice as defined under Israel's Regulation of Engagement in Investment Advice, Investment Marketing and Portfolio Management Law, 5755-1995
• A recommendation to buy or sell securities, currencies, derivatives, or any financial instrument
• A forecast of future market performance
• Tax or accounting advice

Past trade performance is not a guarantee of future results. Trading in capital markets involves risk of capital loss.

04Broker Connections & API Keys

The Service allows connecting broker accounts (such as IBKR, Bybit) using API keys entered by the user. Regarding this connection:

• The user is solely responsible for safeguarding, managing, and scoping the permissions of their API keys. Keys should be granted the minimum permissions required (read-only permissions, without trading or withdrawal access) and unused keys should be revoked.
• The Service operator is not a party to the broker account and does not control the broker's infrastructure, its availability, or its performance.
• Broker connections retrieve data only; the service does not send trading or withdrawal orders. Imported reports may be delayed or incomplete. Responsibility for connection or credential failures remains subject to applicable law.
• Trade data imported from the broker is for logging and analysis purposes only, and does not constitute confirmation, warranty, or guarantee that it matches the actual broker account.

05Market Data & Stock Screener

Market data, prices, scans, and stock screener results are obtained from external (third-party) data providers. Accordingly:

• The Service operator is not responsible for the accuracy, completeness, availability, delay in updating, or errors in the data feed received from external providers.
• Automated calculations, scans, rankings, and parameters shown in the stock screener (including but not limited to RS scores, Trend Template, and other filter conditions) are aids only, do not guarantee an accurate result, and may contain calculation errors or missing data.
• Screener results or market data shown in the app should not be treated as a recommendation, endorsement, or rejection of any investment — see also Section 3 above.

06User Responsibilities

The user agrees:

• Not to upload unlawful or offensive content
• Not to attempt to hack, overload, or disrupt the Service
• To keep their account access details confidential
• Not to share broker API keys with third parties
• Not to reverse-engineer, decompile, or attempt to expose the Service's source code
• Not to perform automated scraping, use bots, or any other automated means to mine data from the app, except through interfaces explicitly authorized for that purpose
• To use the Service in accordance with applicable Israeli law

07Indemnification

Responsibility for unlawful use or breach will be assessed under applicable law. Any claim for indemnification must concern proven damage attributable to that conduct, allow the user to respond, and remain subject to mandatory rights. Ordinary trading losses do not alone create an obligation to indemnify the operator.

08Limitation of Liability

The service is a documentation and analysis tool. Market feeds and calculations may be delayed, incomplete or inaccurate; verify important information independently. The operator does not guarantee trading results or uninterrupted availability. Nothing in these terms excludes liability that cannot lawfully be excluded, or waives mandatory consumer or privacy rights. Responsibility for any damage will be assessed under applicable law.

09Right of Cancellation

The service is currently offered without a subscription charge. Creating an account does not authorize payment. If paid plans are introduced, the price, renewal frequency, included features, cancellation methods and refund terms will be disclosed before purchase. Existing users will not be charged without express purchase authorization. Statutory cancellation rights, including applicable distance-sale and ongoing-service rights, remain unaffected.

10Data Collection, Privacy & Communications

Collection, use, and storage of information within the Service — including API keys (stored encrypted), IP addresses, and usage logs — is carried out in accordance with the Service's Privacy Policy, which forms an integral part of these terms.

Messages sent to the user's email address are, as a rule, operational and system messages only (such as account verification, password recovery, security alerts, and material service updates), and do not require prior consent under Section 30A of Israel's Communications Law (Telecommunications and Broadcasting), 5742-1982. Promotional or marketing content will only be sent to the user subject to obtaining their express prior consent (opt-in), and every such promotional message will provide the user a simple and available way to unsubscribe at any time.

11Intellectual Property

The operator retains rights in original service content and design, subject to applicable law. Third-party market data, trademarks and open-source components remain subject to their owners’ rights and applicable licenses. These terms do not grant redistribution rights in third-party data or override open-source license permissions.

12Changes to These Terms

The current document version is shown on this page. Material changes will be communicated through the service. Updated acceptance will be requested where necessary; continued use does not itself authorize charges or unrelated processing of personal data.

13Termination of Service

The Service operator may discontinue the Service at any time, with 30 days' advance notice. In such a case, users will be given the opportunity to export their data.

14Governing Law & Jurisdiction

Israeli law applies, subject to mandatory protections applicable to the user. Disputes may be brought before a competent court according to applicable law; these terms do not restrict a statutory right to bring proceedings in a permitted jurisdiction.
